The request below for a preliminary ruling concerns the interpretation of Regulation 2005 relating to the protection of animals during their transport (EU Council, regul. (EC) No.1/2005, 22 Dec. 2004: OJEU No. L3, 5 Jan. 2005, p. 1 and OJEU ; No. L 336, 20 Dec. 2011, p. 86), in the context of a proceeding between Zuchtvieh-Export GmbH and Stadt Kempten regarding the decision taken by the latter, as « competent authority of the place of departure », to refuse as part of the export operation with no refund, to clear the customs of a 62 bovine lot that was supposed to be the object of an international export travelling for over 7000 km between Kempten in Germany and Andizhan in Uzbekistan, through Poland, Belarus, Russia and Kazakhstan.
