This ruling addresses two technical issues, which have implications for working time on the road. The first concerns the interpretation of the term “operations centre”, in paragraphs 21 following the judgement of the Court of Justice of 18 January 2001 (Case C-297/99, Skills Motor Coaches and Others: Rec. ECJ 2001, I, p. 573). The second calls for an explanation of Regulation (EC) No 3820/85, 20 December 1985, later repealed by Regulation (EC) No 561/2006 on the harmonisation of specific social legislation in road transport concerning a driver who goes to collect a vehicle fitted with a control device himself or whether, instead, it is driven by someone else, as this has a bearing on the classification of travel time under the concept of “rest” within the meaning of Article 1, paragraph 5.
