The new European regulation on the control by customs authorities of intellectual property rights came into existence on the 12th June 2013 and applies in all Member States since the 1st January 2014.
Long awaited, the new European regulation on the control by customs authorities of the respect for intellectual property rights finally came into being on 12th June 20131. It entered into force in all Member States as of the 1st January 2014, at which date the old regulation (EC) no°1383/2003 was abrogated. The new text aims to reinforce customs activities in the fight against counterfeit goods. According to the Council’s explanations, the draft regulation has a double aim: that of clarifying the provisions relative to the control of intellectual property rights (see ff. 1) and enforcing them (see ff. 2). However, we can only regret that the reform is less ambitious than originally hoped (see ff. 3).
