The fact that a truck driver is with his lorry on a ferry is not to be considered as resting time but as uptime, even if the driver is completely free to do as he wishes during the crossing as long that he has no bunk. The fact that this time is not mentioned on his pay slip is not considered illegal employment. This period of time is not considered actual working time.
This is a very interesting judgment on the EU regulation on driving and resting time, but also on the duration of working time of truck drivers.
