Car registration is an essential part of free circulation. It is organised by directive 2007/46/EC of the 5th Sep. 2007 “Establishing a framework for the approval of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles”. This directive foresees that vehicles need to be “type approved” at the European level by a national organisation, which then must be followed up in all European countries by a right to register. In certain limited defined cases, this right can be classically the object of a safeguard measure for 6 months, notably under the terms of article 29 of the directive, when “new vehicles, systems, components or separate technical units, albeit in compliance with the applicable requirements or properly marked, present a serious risk to road safety, or seriously harm the environment or public health”.
