In the Spasic Case (see above), the Court considered that Article 54 of the Convention implementing the Schengen Agreement (CCAS), under which for the ne bis in idem principle to come into play the first sentence must have been actually executed, was consistent with Article 50 of the Charter of Fundamental Rights of the European Union (the Charter), which contains the principle ne bis in idem with no specifications as to the execution condition of (first) sentence.
