Once again an issue was brought before the Court of Justice of the European Union based on the principle of the mutual recognition of the validity of a driving license issued in a State other than the one that had withdrawn the license. The Court confirmed that the margin of manoeuvre of the withdrawing State is limited to circumstances after the issue of the second license. Case law has given a strict interpretation of the principle of mutual recognition—so strict that one wonders whether there might not be European legal paths to sidestep limits to the right to drive after serious offenses, such as drunk driving.
