The Tribunal of the European Union has partially cancelled the decision rendered by the European Commission of 24 February 2010 pertaining to State Aid provided to certain public transportation services in Denmark between 2000 and 2004 because it was founded on the Regulation (EC) No. 1370/2007 while it is not clearly apparent from the latter that there is reason to apply it retroactively. This means in other words that the funding situations for public transportation prior to 3 December 2009 and producing not the slightest advantage after this date cannot be part of the Regulation No. 1370/2007.
